Refinances can of course be done without an attorney present, and many people choose to take this route every day when refinancing their mortgage. However, engaging in a refinance transaction without at least consulting an attorney prior to signing the refinance papers is not always in your best interest.
When working with a bank or a mortgage company, they do not put the protection of your interests first when reviewing refinance terms with you. It is of no concern to them whether or not the terms of the refinance are favorable to you or not, and they not even be able to explain everything to you clearly, in a way that you can understand. They may put pressure on you to sign the refinancing forms without fully grasping the terms of the refinance and without giving you time to ask questions.
It is also imperative that the mortgage you are paying off by refinancing is discharged properly. Should you desire to sell the property at a later time, you may have difficulty doing so if you cannot show proof of clear title. A poorly handled refinance transaction is responsible for many delayed closings and could create trouble for you in the future.
